From the bank's perspective, a check isn't money until it clears the issuing bank or other financial institution.

That said, it was still stupid. It's part of the reason I'm with a credit union today.
Paychecks are typically an exception to this.

Well it certainly brightens my day to know that a corporate bank was given the shaft. Now, let's go after the insurance monopolies.

Don't bank there but sheesh... that is one of those things you hear about and hope you never have to deal with, yourself! Glad the publicity is making a dent on their coroporate image. But I'm doubting they'd ever pony up and pay for the guy's expenses. That would set a precedent and with the track record they most likely have, that'd be VERY costly over the long run, I'm betting!

$26 million have been withdrawn!

I am currently listening to the audio feed on the website where two BoA representives (Senior VP and Director of anti-money laundering) were talking on the air to Clark Howard.

They start out, talking about all the dangers of fraud these days and the training that their employees have on reporting fraud to the government.

Clark says that with that said, this guy Matthew did what was right, meaning that he challenged the validity of the check and asked the bank of origin if the check was real. The employee confirmed that the check was real, which was false. They respond that they followed protocol as the law demands.

Both BoA reps. are not speaking in specific terms to Matthew, rather they are talking in generalities and beating around the questions with answers that any politician would be proud of.

Copying the next section from the website, Clark Howard's page tells what happened next on the conversation:

After the second on-air discussion with BOA officials, which involved asking how customers could legally verify a check, Clark had an off-air discussion with Alexandra and John. In it, Clark told them he was standing his ground with the challenge. He also told them they had not provided people with a way to verify possibly fraudulent checks without being arrested. Bank of America officials still had no answer and admitted no wrongdoing. At that point, Clark gave them an out and said he'd be willing to pay for half of Matthew's legal fees if they paid the other half. They refused. And, so the story continues.

So the question is...why would they not answer the question as to what is the correct procedure? I think it is because they know that Matthew DID follow proper procedure and that they are trying to make it look like he did not...and therefore they would not answer as to what can be done differently to avoid this again because there is nothing better to be done. Matthew did what he was supposed to, and BoA knows it...and that is why they refuse to answer the questions...knowing that they'd prove themselves wrong.

out of his own pocket? [/QUOTE]I was thinking that he has some control of funds from the talk show, (or maybe got permission to make the offer). However he does have a good paycheck, from what I hear...

Ugh. I use that bank. Sorta. They don't have a branch around here, so my old account sits there bleeding $5 service fees every month. Now seems like a good time to actually close it.

What exactly is a service fee? Does everyone have to pay it?
