I have a legal matter, mainly directed at Timber Loftis and other laywers if he is still on here...

Do internet posts hold up in court?

For example...

Say I posted on IW that I did something. If a court case then resulted, would that statement hold up in court?

Because there is the chance that im lying, that it was someone else using my username etc.

Anyone got a definate answer?

Not a definite answer, but something that may help to draw a comparison.

Under English contract law, an email is acceptable as confirmation despite the fact that they are easily spoofed.

well I'm pretty sure your IP address is recorded and traceable via your ISP if they got a court order for the ISP to divulge who that IP was assigned to at a particular time and date. Therefore the post can be traced to your computer, but it's hard to prove YOU wrote it at your computer if others have access to it. Plus the admin of a site COULD edit posts without an edit message appearing so there would still be doubt as to its authenticity. But to answer your question directly.... I don't know

Well, I need to know really.

The post has been deleted, and it was made a couple of months ago. In fact, I very much doubt there is any record of the IP or where it was posted from etc etc.

But they have a printed copy of the post, and I wanted to know whether it will hold up if it gets too court.

Regardless of whether it will stand up in court, you are taking a big risk by asking IN ANOTHER INTERNET POST!!! you could reasonably have denied writing the first post, but now by coming here and asking whether 'your' post would hold up, you are admiting you wrote it.

I'm no lawyer, but i think it might depend on what kind of case. if it was defamation/libel, then yes it probably would.

i would suggest you go see a lawyer in your home town, and talk to them. Good luck.

I said for example, and asked if it would hold up in court.

They have a printed version of a post supposedly made by me, under one of my assumed user names.

However, I never said the post was made by me lol.

Could of been anyone!!

Anyway, my point is, does this printed version stand up in court. They have no IP address with it, no proof it was me posting it, except it was "supposedly me" talking about my personal possesions.

Long story short, someone admitted to speeding/racing in my MR2T. It now might be going to court...

And it's not a criminal matter Ivelliis, it's a civil one.
