I'm not sure I could get that drunk where I would leave a decapitated body in my car.
-------------------------------------------------------------------------------- Man held in decapitation accident released Wednesday, September 15, 2004 Posted: 1147 GMT (1947 HKT) MARIETTA, Georgia (AP) -- A man facing criminal charges for a freakish accident that decapitated his friend has been released from jail after the victim's relatives pleaded on his behalf. John Kemper Hutcherson's bail was reduced from $100,000 to $50,000 and the 21-year-old man left jail Tuesday, thanking the family of Francis Daniel Brohm. "I want to thank the Brohm family for supporting my release," said Hutcherson, who faces a vehicular homicide charge. Police said Hutcherson was driving drunk August 29 when he swerved near a telephone pole support wire, decapitating Brohm, 23, who was leaning out the truck's window. Hutcherson then drove 12 miles back to his suburban Atlanta home and slept in his bloody clothes, leaving the headless body in his truck until a neighbor discovered it the next morning, police said. District Attorney Pat head said the new bond is consistent with other vehicular homicide cases. "The decision is based on our assessment of whether he is a flight risk, whether he might intimidate witnesses and other factors," he said.

Wow, how could you forget a headless body in your car???
I really dont think he should have goten his bail reduced, the victims relatives might have pleaded and got him out of jail, but he still killed his friend. |

Yeah, I am left marvelling at why a family would want a penalty lessened on the man that killed their son.
I do not understand this at all, but maybe there is more to it than I have read in the report.

Here in Omaha we had a guy driving drunk .19 and crashed into a pole. The crash threw his best friend out of the vehicle and killed him. All that happend was he had to do 60 AA meetings in 60 days and he spends the night in jail on the victims birthday, the day of the accident and Christmas. 3 years probation. There is a mantality that boys will be boys in the midwest.

I think it is justified. It is obvious that the guy was driving drunk, but he was not the one hanging his head out the window risking an accident like what happened. The "Darwin Award" nominee, was obviously drunk as well. That is probly what the family is considering when pleading for the driver.
The fact that he put the "headless wonder" in his trunk, and drove home to "clean up in the morning", could be considered malicous, but probly just another genious idea of a really drunk mind. I think he should get a conviction for the DUI, and maybe even V.M., but to a low degree. We need Timber for this one... All this IMHO of course. ![]() [ 09-15-2004, 11:49 AM: Message edited by: LordKathen ]

I agree with Kathen, even if driving drunk is one of the biggest crime in my book, hanging your head out of the window of a moving vehicle is just something you don't do... no matter how drunk you are...

I don't really care how drunk you are, you don't tend to forget that you've got a headless body lying in your truck. The blood would've been the first clue of that anyway.

I think he shouldn't have been put down in the first place.
Ok, so he was drunk, get his license taken off him and give him a fine. He didn't kill his friend. He was the driver. His friend must have been totally out of it to be sticking his head out the window, which was nothing to do with the driver. Passengers have to take responsibility for themselves.
