Civil marriage is a civil right. Thank San Francisco Mayor Gavin Newsom for standing up for inclusion and civil rights for all. - Thank him for breaking the law? No thank you. Civil disobedience may have its time and place, but sit-ins and mayorial misbehavior are a bit premature on this one. Additionally, it is reprehensible to use your position of power in the government to break laws and ram through governmental legal acts (performing marriages) that will simply be obliterated once judicial review comes around. Go to a sit in or a protest, but don't abuse the office of mayor by allowing illegal marriages to continue. If ever there was a topic where the federal government should stay out, it's this one. Morality laws should be determined by the state. The affect on interstate commerce is too attenuated, and if it doesn't affect commerce between the states or is not a power otherwise specifically granted by the Constitution, state law should govern. I agree with the theory, mind you, but it's not really for the feds to control. And, yes, I realize I'm undercutting Roe v. Wade. He is a right wingnut. However, the namby-pamby far left wingnut liberal idiots that generally comprise the 9th Circuit (the most overturned Circuit of them all) are known for their "wacky" judicial opinions. Change and progress is one thing, but these loonies can't get over the extreme leftism long enough to undertake and honest legal look at issues. William Myers, therefore, would be a welcomed balancing viewpoint. He could help even out the keel of this radical nutty circuit. So far I've done Mad Cow, Ford, Halliburton, War Profiteering, and Energy Legislation. I am still in ponderance of some of the others.
I also still ponder whether petitions actually do any good, but I figure it couldn't hurt. ![]() |
