Does Vhailors Helm REAlly Work everytime i use it it just says Save vs death why dont i get a simulacrum?

I remember someone else complaining about the issue too. Looks like it uses a spell that allows a save to spawn that Simmy, and your char is simply saving. An item code bug. Ever tried Baldurdashing? Check the sticky 'Forum rules ...' thread by Dundee to find the link.
Anyone ever encountered the bug? Overcame? HOW?
