So did the guy have a bomb or a weapon or not? This detail seems missing from the various articles I have reveiwed.

Part of a report has said that 'an eyewitness' "he appeared to be wearing a bomb belt, with wires coming out" (15 seconds of fame?). This would very well explain the actions of the police. In any type of Urban Operation where innocent people are subject to harm, the SOP is pretty standard. Cover, Smother, and unload until the perp stops moving. Cover as in drop him to the ground, smother him with as many armor protected bodies as available, and unload 'shoot' until 'his' movement stops.

Then again, he could have been an innocent person who doesn't speak the language, dressed what he thought was appropriate for the occassion, and wore a money belt with the strings open to view. Did not understand the police, and could not figure out the hand gestures. Decided to use the subway after exiting a building that has been under police surveilance for the last few days, the whole while being followed by said undercover police. WOW. What a coincedence.

Funny, I read a whole slew of eyewitness accounts. I don't recall anyone claiming wires or such were visible. Anyhow, the offical word is all I care about.

Killing the unarmed is what the terrorist's do. it is what we guard against and what we condemn. Even accidential killing cannot be excused lightly. Respect for life and due process is part of what makes us civilized.

Now, if it turns out the guy was armed then he got what he deserved. That's war- kill, and die.

Indeed! Different article here including a graphic showing the sequence of events.

Given he vaulted a ticket barrier to escape police and get onto the train then refused to stop again I'd say they were justified nontheless.

According to the info I have heard on the radio (yes, I'm a talk radio listener) the Brazilian man:
Lived in the same building as other Muslim militants being watched.
He wore an oversized coat, much like the ones suicide bombers in Isreal wear.
He didn't stop when police told him to.
He ran toward the trains filled with people.
He was shot 7 times in the head and 1 time in the shoulder.
According to BBC he had an expired VISA so he was an illegal immigrant. (which explains why he was running)
