Only in that incumbents can create free air time by posturing on this or that issue while in office. It is a problem that can be worked around.

Yes, or we could set up a private entity that decides whether any given bill fits within Article I, Section 8, rather than the "fox guarding the henhouse" concept we have today. If we brought the power of Congress more in line with the intent, there would not be much incentive to lobby them in the first place, since they would not have the power to give favors to cronies...
