What level do you have to be to use 5th level spells. I'm level 5 and I found cloudkill and learned it but when can I use it?

Oh, and BTW, unless you have ToTSC you can't memorize it because of exp cap.

which is most annoying , dont see the point of that, should call it a 9th level spell only learnable at 9th level, never got why they did that

It follows the Advanced Dungeons and Dragons spell progression chart. As to why Dungeons and Dragons was set up that way, I can only guess.

Because thats the way it is. It helps make the mechanics of certain spells (Spell Trap and such, not present in BG1) simpler for PnPers. Besides a bard will get spells at different levels to a mage, so it would end up even more confusing.

yeah in games systems like ad&d theres no problem calling an apple an apple, they could have reordered it with ease (i used to write rules for various RPG games a long time ago) just a matter of getting the balance sorted, and i did mean the original people not the baldurs gate people as they are only working off what they have been given

probably the easiest to understand reason is that in PnP if you only get a new spell level at every other level then you will be forced to learn how to use the spells you've got more creatively, as well as it allows them some leeway instead of having to write in twice as many spells to go with the doubled # of spell levels, which would be totally against the PnP rules anyway.

Yah it is around level 8 or 9, if you have a specilist mage you will get to use 2 of them.
