Okay, Ironworkers, bear with me here.

I get these daily briefs from BNA, a legal service. I was thinking that, if folks are interested, I'll post them here every few days. The email I'm cut-pasting has a ton of links. I'm not removing them because it's time consuming. But, it's a pay site and if you try to link to them the full story won't be available. Think of this as the enviro equivalent of the News in Brief section found on the front page of the WSJ.

So, please give a little feedback. If you appreciate this post and would like to see more, let me know. If you find a particular article of interest, PM me and I'll try to let you know more. However, you could just look the stuff up on EPA's website or using a google.com or alltheweb.com search.

The articles range over all issues, form Toyota spending $34 million on clean technology to avoid Clean Air Act liability to EU nations who oppose mandatory environmental insurance to the billions the US will spend in water infrastructure next year.

If I get no feedback, I'll assume it's a waste of my time.

SMALL OIL, GAS PRODUCTION SITES GAIN MORE TIME FOR
STORMWATER PERMITS

EPA gives small oil and gas production sites two more
years--until March 10, 2005--to get their stormwater
permits. The rule is being published today, the same day new
stormwater permitting rules take effect for small
construction sites and municipal separate storm sewer
systems. Under those rules, known as Phase II of the
stormwater program, municipal separate storm sewer systems
serving populations of up to 100,000 people and most small
construction sites disturbing one to five acres will have to
have a National Pollutant Discharge Elimination System

EPA APPLIES AMENDMENTS TO NEW SOURCE REVIEW TO 11 DELEGATED
STATES

EPA's changes to the clean air enforcement rules for
industrial facilities across the country will apply in
states without their own, approved new source review
programs, under a final rule EPA is publishing today. EPA
published a final rule Dec. 31, 2002, to create exemptions
to the new source review requirements for the installation
of modern pollution control equipment when facilities make
modifications that increase emissions. According to the
agency, it failed to apply the revisions to those states
with new source review programs operated under federal

TOYOTA TO SPEND $34 MILLION TO SETTLE CHARGES UNDER CLEAN
AIR ACT

Toyota Motor Corp. agrees to spend as much as $34 million on
pollution control measures to settle charges that it
violated Clean Air Act rules for more than 2 million
vehicles manufactured between 1996 and 1998. The Justice
Department says the settlement requires the company to
accelerate compliance with new emission controls, pay a
$500,000 civil penalty, and spend an estimated $20 million
on a supplemental environmental project to retrofit up to
3,000 diesel vehicles with pollution control equipment. . .

CALIFORNIA SHIFTS ZERO-EMISSION VEHICLE PLAN FROM BATTERIES
TO FUEL CELLS

The California Air Resources Board releases a new round of
proposed changes to its zero-emission vehicle program,
which, if adopted, would eliminate annual sales quotas for
automobile manufacturers willing to sell fuel cell vehicles
over the next five years. The board proposes to allow
manufacturers to comply with the regulation with credits
earned by increasing the number of near-zero-emission
vehicles they put on the roads each year or by agreeing to
make fuel cell vehicles available over the next five years.
Automakers would earn credits for cars introduced in states
that have adopted the California program, currently just

PENTAGON RENEWS EFFORT TO WIN EXEMPTIONS FROM ENVIRONMENTAL
LAWS

Defense officials renew a campaign to win congressional
support for proposals to exempt military training and
weapons testing activities from a number of environmental
laws and regulations. Raymond DuBois, deputy secretary of
defense for installations and environment, tells a Senate
subcommittee that compliance with some environmental laws,
including those covering air and water pollution and
hazardous waste, is compromising U.S. training activities

EPA FORMS PANEL TO PROVIDE ADVICE ON PROTECTING ECOLOGICAL
SYSTEMS

EPA's Science Advisory Board is forming a new panel to
provide advice on regulations and policies that protect
ecological systems such as wetlands and forests. In
particular, the agency says it is seeking scientific
guidance on measures "to improve quantification and
characterization of benefits of protecting ecosystems and

GAO SUGGESTS FINDING BASELINE OF AIR POLLUTION CAUSED BY
AVIATION

A new Government Accounting Office report recommends the
Transportation Department establish a baseline of air
pollutant emissions from aviation-related sources in order
to reduce emissions in areas that are not attaining national

NEW DEPARTMENT EVALUATING VULNERABILITY OF CHEMICAL PLANTS
TO TERRORISM

The Department of Homeland Security's Information Analysis
and Infrastructure Protection directorate is in the early
stages of an assessment of the vulnerability of the nation's
chemical plants to a terrorist attack, according to a
spokesman. It is unclear whether the Department of Justice
will complete a similar vulnerability assessment, which it
was required to conduct under a 1999 law. The Justice
Department's Office of Domestic Preparedness, which had
responsibility for completing that vulnerability assessment,
has been transferred to the Homeland Security Department's
Border and Transportation Security directorate. . . . Page

SENATORS SUPPORT $5.2 BILLION FOR WATER INFRASTRUCTURE IN
FISCAL 2004

Funding for wastewater and drinking water infrastructure
should be increased to at least $5.2 billion in fiscal 2004,
a group of 33 senators tells the Senate Budget Committee.
Specifically, the senators suggest, the clean water state
revolving fund should be at $3.2 billion and the safe
drinking water fund at $2 billion. Those funding levels
would more than double the fiscal 2003 appropriation of $2.2

declined 4.7 percent in 2002 but the share that came from

A. I've been told this type of thing is an overload and isn't conducive to debate. I'll keep posting on it, but if there is a particular topic you see and want to debate, please start a separate thread.

B. In keeping with what Z asks, I will post all updates in this thread - until it gets too long then I'll either delete it or let it fall off and start a new one. (Let me know if there are problems with this approach Z).
