Assemblyman PETER J. BIONDI
District 16 (Morris and Somerset)

Mr Biondi has decided that it should be a NJ law that operators of public forums must either require users posting to be identified by their legal name and address or that the server operator maintain accurate records of the legal name and address of anyone posting to a public forum.

The bill would also make the server operator liable for both compensatory, punitive, and all legal costs if someone feels they are 'harmed' by a message and the operator fails to establish, maintain, and enforce a policy obeying this proposed law.

Here is a link to the Bill:

Here is the phone number listed on his website:
(908)-252-0800
So how would this affect us? No more use of nicknames, or are we supposed to be extra polite to each other to make sure no one is "harmed" by a message?

It would seem to be nonsense. The net, if it were to be regulated, could be only regulated by the US gov. You know only the feds can regulate interstate commerce.

Sorry... this won't go anywhere. Why?

1. Ziroc's in Florida, not NJ. I don't believe NJ can pass a law on a Florida resident.

2. The feds can't even govern it, since they can only address one country. Last I looked, there were over 150 others. And they won't let the US pass all their laws for them (comments to the contrary to the CE forum, please ).

3. This appears to me like an obvious re-election ploy. Pick an issue that can't be resolved, do the "right" thing on it, and get elected. Again.

4. It only applies to entities "qualified to do business in the state". I suspect Ziroc doesn't qualify, so no problem there.

5. Terms like "feel they have been harmed" are too broad and vague and will need to be clarified.

Ergo, nothing will come of this critter.

You missed my point, but that's okay.

Then do help me, friend Larry... I'd really like to find it. What were you trying to get across?

*edit* To be sure, I don't think I was as clear as I wanted to be on that point. Said differently, NJ can pass laws that affect NJ businesses, including those with a presence in NJ. I don't believe Florida (or any other state) would let NJ (or any other state) pass a law that affects how they do business in their own state.

Hmmm... I still don't think I'm clear. But hopefully, I'm closer.

Another possibility is that they are trying to monitor who's talking to who, ostensibly under the cover of monitoring who's talking to our children and what they are saying. It's utter hogwash though, and probably won't go very far.
