Hmmm..I don't see anything wrong with that. I find that it is a much easier way to do than to go for a lengthy court battles. where it will cost lots of money. too bad though I'm not a muslim.

The lengthy court battles aren't usually because one person wants the divorce and one doesn't and they're deciding whether they should be allowed to divorce. People go to court to decide what each is entitled to because they are getting divorced, which I can't see this law having any impact on. I don't know what sort of alimony and so on women are entitled to under Shariah law, but that really isn't an issue with this as far as I can see. This is merely an alternative to saying 'I divorce you' in person or serving them with divorce papers. The court battles come AFTER that.

Anyway I think it's terribly cold. I can see how technically it would be legitimate but I wouldn't want to be married to the type of man who'd take advantage of it at any rate. I can imagine her receiving the message okay, but I'm having a hard time picturing a man actually getting out his mobile and texting off his decision to her! So impersonal and dismissive! Would it be three separate SMSs? Or just three 'I DIVORCE U' in the one message? [img]graemlins/idontagreeatall.gif[/img]

yes, that's why the malaysia thing is good because the husband can just type the message in the handphone and bam! they are divorce. If my memory serve me correct they still need to see an ulamak ( an islam elder or something like that ) for the alimony thingie.

I find it hard to think a man would divorce his wife as whimsically as some of you are picturing. It's not like it would come out of the blue. Most divorces are marriages that fall apart over a length of time, not the hubby suddenly meeting a redhead as was suggested and suprising the wife without discussions, arguments, periods of zero communication or absentia.

In any case I find Australia and America's systems quite bizzarre. Aelia, you are correct to a point about domestic court battles IN AUSTRALIA. However, I'm told that in many American states grounds for divorce must be proven and so a couple may go to court to prove the marriage is unworkable.

Additionally, even in Australia, there are laws regarding divorce. The couple must prove they've been seperated for at least a year. Seperate addresses. They can go to court and get a divorce earlier, but special criteria must be met.

As for propety divying up, we used a government mediator rather than a courtroom. Was a lot cheaper.

Not that cold, provided your marriage is for business purposes rather than 'love'. The concept of marrying for love is a lot newer than you think. The idea only caught on as viable in 'Western' culture within the past century or so(with arguably negative results for wealth distribution as a whole), and it's still largely unadopted by those living under Islamic law. In the Malaysian cases referred to here the divorce would more likely be in the context of ending a business contract with a different family than giving your sweetheart the cold shoulder.

'Your famiy's property and influence is no longer essential to the furthered prosperity of mine. I divorce you, I divorce you, I divorce you'.

Doesn't sound that cold really.
