Fair use applies to this since it is non-profit. I have spoken to a lawyer about this as I have also read up on alot of FAQs including the US gov't. one.

Fair use is narrowly defined, and as I said, doesn't apply in the Berne convention. Don't know if this has been contested yet or not.

By the time I retire, I suspect the Internet, because of its non-national boundaries, will fall under Berne wrt copyright.

In any case, what's wrong with asking permission?

nothing wrong with it.
but i do want to start making my ownportraits once i get my scanner,
but it would be overwhelming to try to find all the people that made the art i would like to use.

Look 'em up on a search engine. If they have a website, read their legal stuff to see if they will allow it -- Boris Vallejo and Michael Whelan don't. Ask, be polite, and tell them exactly what you're doing (and don't leave out the size alternation!). The majority will give permission.

A little CYA goes a long way.

a few easier ones to find will be Marvel comics, DC comics, wizards of the coast, some harder will be individual image comics artists. being told no would just suck

Just use the Fair Use laws and it would be just fine. Just as long as you are not taking credit for the pieces of art, not making money from it, and not using the whole pic (kind of like getting music samples off the net) I see no problem with doing portraits. Its not like the site would be stealing money from the artist. I would go for this as an artist because it would give me more exposure and such.

Well, being told no is something you have to deal with. And if you didn't ask, and an artist found out and wasn't happy, they could still tell you to remove it. And, very likely, tell their friends and associates about you.

It comes down to respect. If you like an artist's work enough to want to use it, you should respect them enough to ask.

Don't know what Marvel's policy is about their characters being used ... that might not be a good idea; they're a corp, and corps frown on their property being used w/o permission. (Might have better luck if any of their artists have put up their =own= work somewhere.) Likewise, do =not= use any stills from the Star Wars movies. If you're caught, Lucasfilms will slam your butt into the ground! :eek!:

Under the Fair Use the site would be legal. So who cares what other people think. As long no laws are being broken its just people's opinion, nothing more. Frankly people just need to be less anal about these things, Lucasfilms included.

Most portraits use just a small bits of a greater piece. Its like d/l a 1 minute song sample from a 6 minute song. The user makes no money and the artist doesn't lose any money and the artist gains more exposure. Its more of a win for the artist than anything else. Frankly if someone uses my work on the web, as long as they don't take credit for it, I have no problem with it.

That is sooooooo true. I mean so long as they credit you for the artwork then they are getting free publicity. If they have a problem then they can email you about it but why should they have a problem with their artwork getting well known through others sites?

Exactly my point. That is why technically LN site was legal along with Iago's. It wasn't till someone I won't mention *ahem* made trouble and harassed them to no end. I'm just glad that LN's site is backup now.
