I'm not currently a member of the morag tong and i wasn't planning on becoming one. Surely that's not the only guild/place where i can get one, is it?

unfortunately, AFAIK, that's the only place where you can get the spell.

I'm afraid so, unless someone wanna tell me they got other way of getting such spell the legal way.

I made one where one cast of restore magicka can restore you 10 magicka points. I let the balmora mage guild transporter lady sell it. however, If you buy it you can't create another one of it via spellmaking and also you can't enchant one item using that effect. this is strange I must say.

Strange yes, but i can sorta see why they made it so. The cheeze potential for super-mega-insane-bullshit weapons is already pretty high with the CS. Adding the ability to create your own super spells and then enchanting your own super items with them may be going a bit far.

However, for a creative imagination, there's even more potential for balanced items than there is for overpowered so it would have been nice if the option was included.

Oh well, back to the drawing board...

The Tribunal patch 1.4 does almost nothing. since Bloodmoon is coming out there no need to download the patch.
