I'm curious as to how you disposed of 200 gallons of oil in a day.
Also, like others have said, should you sell the house and NOT tell someone that there's an old oil tank buried in the yard, you could be looking at some serious legal issues later. It's not like you can claim you didn't know it was there as there are those who know you were told when *you* bought the house. Besides, what if you sell your home one day and the new owners suffer injury or property damage as a result of your non-disclosure? Wouldn't you feel bad about that? I read what you wrote, Ronn.
I was just surprised that, if that's the route Larry took, the company came with less that 24 hours notice and picked it up. It was my experience while living in Florida that the company will agree to buy it back (as they did when I moved and they came to empty the propane tank), but it often takes them days to weeks to get someone out there to do the job. I did not do a final 'settle-up' with the propane gas company until a couple of WEEKS after I'd moved back to Georgia. Hence my curiosity... |

The lady that keeps our kids while I am at school uses oil. In exchange for the oil, we get three weeks free daycare...which comes to the cost equal to $225.
She had alot of jugs.

I should have seen that coming...
Anyway, about the old buried tank. What if I mention to any potential buyers about the existance of the tank...and how I buried it before selling. If we have to dig it up then, then so be it, but if they still buy the house, knowing it is there...will that not be a transfer of responsibility?

Larry, the question is what was in the ground before you emptied the tank. It's a soil impacts question -- and maybe groundwater too. If the tank dates back only to 1980 it will be listed in regulatory databases -- normally if it's over a certain amount of gallons, which it appears to be. If it predates the 1980s and isn't on regulatory databases -- then you potentially have a bigger problem because those old tanks would rust and leak.
If you were an innocent owner who did not install the tanks, you just may be able to get state money (from the LUST fund) to fix any soil contamination impacts and remove the tank. Look, I'm too far down the line here in giving legal advice to a non-client. You want to do it in a way that won't be at all questionable to a prosepective purchaser, then PM me or see a consultant. Otherwise, the best advice I got is to delete this thread. |
