Well, it happened. I finally put my foot down about my ex-wife paying child support. So, I find a summons for a civil custody suit on my door! [img]graemlins/1pissed.gif[/img]

What a pain in the [img]graemlins/moon.gif[/img] ! An expensive one at that! She's already trying the dirty dice. She talked to my lawyer and he didn't catch who she was at first. Well, now he can't represent me, so I had to find new representation. It bought her some time. She tried this same stunt with her other ex-husband when he asked for support. She lost badly, but he was remarried already. At any rate my guts are in knots! [img]graemlins/1puke.gif[/img]

The money I had saved up to buy an engagement ring now has to be used to pay attoney fees! [img]graemlins/1pissed.gif[/img] I can't move when I want to because that's one of the things mentioned in the petition. The petition is also filled with LIES! DAMN LIES! [img]graemlins/1pissed.gif[/img]


Let me tell ya! The gloves are off now!! [img]graemlins/imtough.gif[/img]


Luckily, my lawyer says that it's easy to file, but MUCH harder to win!

OH you poor thing.....I wish i could help you, but not sure what i could do, if you ever need someone to talk to i am here, i do know a little about what you are going through, myhusband has 3 other kids besides ours, and if i can give any advice i will be happy to do so

Thank you for the sympathy Stormy. The story of my divorce and unlikely custody case from 6-7 years ago is a long one. There were a couple of times I didn't play things too smart and here is where I may pay the piper for it! Luckily for me, she NEVER played things too smart, but she's seemed to wise up the past few years. Remember kids, always go for the neck when you're dealing with divorce and custody. Do it by the book or you risk explaining, and thereby exposing yourself.

again I am sorry for you, I hope everything works out fpr you,i was in your shoes once, but we got back together and things are a little better, the kids are the ones who pay for the fights and i am NOT trying to say it is your fault, so please don't misunderstand me, but remember your kids in all of this and let them know you still love them [img]smile.gif[/img]

Almost 5 years ago, my wife and I seperated. It was a hard time and I moved out for over a year. I paid her $400 weekly and lived off pennies, because I loved my son and didn't want him to go without. I went from portly down to a size 32 waist over that year. Eventually, we reconcilled....and for me now, life is Very good.

She knows she can't push me around.
She knows that a fights not over until we talk it out and resolve the issue.
We respect each other a Lot more now and it helps us do more for each other.
We even have a new baby (well, 7 months), something she never would have agreed to before.
I've even managed to keep most of the weight off and make time to work out regularly. (last summer I almost made it to the top of a rock climbing wall at a Six Flags near us. Laugh all you want, but its pretty good for guy pushing 40 who used to be a flabby couch potato)

What I'm trying to say is that bad times Do Suck. But its what you Do to get through them that will make you the person you always wanted to be: The person that your child sees you as.

Thanks Cloudy. Yup, I've already got another one. It did give her a week or so to gain time though. Now I have to file countersuit instead of suit. A minor detail that shouldn't matter, but every little bit helps.

UPDATE:

Went to the first mediation today. What a complete waste of time! We didn't even make it into the meeting room! The lawyers put their heads together for about two minutes. The consensus? She want's complete custody turned over to her, nothing less. I said hell no! :1flick:

I asked my lawyer what makes them so sure they'll get custody. He said "They don't". Apparently, buying time is the key. Who knows what they'll try? The next step is that they have to get a custody evaluator to determine if a change in custody is warranted. If they drag it out this month, my son will have to go to summer school here and I won't be able to move. Hell, that's probably half the reason for this. They know I have all my plans set for South Bend. Now, all those plans are worthless. Laporte has crap to offer for summer kids programs. Not to mention, the fact that I'm working in South Bend means that I'll have to arrange for other people to ferry him to them. What a crock!!! I've also got Di chewing my butt because I "let" this happen. I hate to say it, but she's right. If you stomp the non-custodial parent into the ground, they don't have the strength to fight back. Every favor I ever did for her is being thrown back in my face as an act of irresponsibility making me an unsuitable parent. No good deed ever goes unpunished, huh? These are the things in life that jade you. All this hell because I wanted her to pay half of what the guidelines say she should pay for child support instead of the nothing she was. Let me tell you, when I win, she'll pay it all right! And on time too!
