From the Cleveland News...

I'm almost certain she's displayed herself to be a potential threat to others and or herself. She ought to be baker-acted (sp?). At any rate he wouldn't be the one to foot the bill since she's no longer attatched (at least in the legal sense) to him. She's essentially turned to stalking and making his life tough, if not miserable. I'd have filed for a restraining order against her for harassment by the time they went through half of what she put them through.

I'm sure he's not footing the bill, but there's a wrinkle in how he handles this - the daughter.
If there's no daughter, restraining order, stalking charges, and away you go. Since there is a daughter... (mommy voice) That bad daddy got me arrested and thrown in jail I know she'd say something else, but you risk no longer being Dad, and instead being the guy who imprisoned Mom... sick and twisted as she is. And at 9 or 10 (or so), you really don't want to go there... especially since it *appears* to have been brought on by Mom's accident. There's no good way for him to win.

Firestormalpha, I'm pretty sure the Baker Act is only in Florida. See the FAQ on Baker Act reform. For the rest of you, BA allows a judge to have a person involuntarily committed for psychiatric evaluation for up to 72 hours. Problem being if they can stay clearheaded long enough to show a Dr they aren't endangering anyone, they get kicked loose. Does anyone know if there's anything similar on a federal level, or if Ohio has anything like that? If she could be declared incompetent that should stop her from filing any more nuisance motions.
At the very least, when she tried to charge him with kidnapping using 5 year old documents, I'd have had her arrested for making a false police report.

what is sad is the default option of granting custody to the mother in the beginning. Men are always the victims by default and have to prove innocence.
