rabid organ donor
my husand was telling me this morning of this, so I decided to check on it, and found the information was pretty outstanding, how can they not know they guy was sick?

Maybe they're so short-staffed and desperate for organ donors that they didn't ask enough questions.

I thought rabies was a requirement to live...nah, it's been done to death.

Short staffed or not, doctors have a certain obligation. To not do proper testing is malpractice, plain and simple.

I have no clue, he seems to think that rabies is not a thing you should run test on a dead guy for :/...thanks about the sig, I am trying to get it with an invis back, but still learning photoshop pro 8 and can not get it right

Malpractice means bad mistake, mkay.

Whether or not this was malpractice depends on whether or not they shoulda checked for rabies. I would say that generally the answer would be that you would not expect a doctor to check for rabies. Let's be real, you can't check for EVERY possible thing -- it's cost prohibitive and likely nearly impossible. As well, "this report describes the first documented cases of rabies virus transmission among solid organ transplant recipients." So, you certainly can't test for every 1 in a gazillion possibility.

However, if the doctor should have known that there was a particular problem with the patient, the doctor should have added to the list of tests.

* Did/should the doctor know about the patient's rabies infection? Fact question for the jury. Probably not because "in the case reported here, the donor's death was attributed to noninfectious causes," so the good Doc wouldn't know to suspect an infectious disease like rabies.

* If the doctor knew, could he have ordered additional screening tests of the organs? If not, I say it's the hospitals flaw, not the Doc's. I suspect doctors can and regularly do order additional screening for organs where infectious diseases are concerned.

Verdict: no malpractice.

I guess we've been told.

I stand corrected, no malpractice.

So if a give the doctor a good ass kicking for giving me a rabies infected transplant, is that considered assault?

EDIT: That advice isn't going to cost me anything is it Timber? I'm usually charged about $300/hour for legal advice.

but he exzhibited the signs, change of mental state, low grade fever should that not be taken into consideration that something was not right? the last time I knew someone who had altered mental status, they ran every test from rabies to parkinsons. perhaps it is not a malpractice...but it could still be made into one

The problem with that is imaging test that was done showed a highly probabal cause for the donors condition and death.Also the only test for rabies is the Fluorescent Rabies Antibody test,which requires a physical examination of the brain tissue.There is no test for any other organs or fluids.This is why if you are bitten by a potentally rabid animal and they can't catch and disect and test the brain, it is assumed you have rabies and are given a horrific bunch of injections not only in the number of shots given but also the lenght of the needles involved to actually inject the nessary organs.I feel horrible for the people involved but I can't see any wrong doing on the doctors part.
