This thread is an excercise in stupidity. It's like some of you don't even read others' posts, you just keep going on with your tirades and antics about POWs and trials and whatever you think of when the moment hits you, not even bothering to check if the question has been brought up seven times before.
And if you think for a moment "Is he talking about me?" then yes, I am talking about you. Reread the thread.

I think it is also because of the way they want to try them - military commissions - which have been continually challenged for their legitimacy and fairness. It would not be a good thing for the Bush administration for one of them to be tried in front of a military commission and then the ruling be struck down as illegitimate.

[/QUOTE]People that breach the Geneva convention are guilty of war crimes, so whether they have it on their minds or not, they will pay the piper eventually as so many ex-nazis found out. There is talk of Germany wanting to bring Rumsfeld to trial for example.

Just because "everyone does it" does not make it right or even defensible if you're caught.

No. David Hicks was taken into custody 4-5 years ago. Hardly a "current event".
