I can't install my ToB, everytime I try it, I get an error message. Plus I bought it in America, so it's not like I can take it back to the shop or anything

What error message do you get?
If it is a faulty disk it doesn't matter where you bought it. When you buy a game, you are buying the right to have a master copy and a backup. The actual material disks are not as important, and Interplay will likely replace the disk for the cost of postage.

Well I have the dutch version of Windows, so I guess telling you the error message wouldn't help much
