The guard *could* have just *not noticed* the shirt. Which is what I would of done...

The mall created the policy...they should have had the backbone to accept the bad publicity from it. They could then have discontinued the policy, which would have made everyone happier....but instead of taking responsibility for their poorly thought out policy...they looked for a scapegoat.
