I choose not to smoke, and I also choose not to frequent establishments that allow smoking. That's my choice to do so, but I don't need legislation to tell me that. I will simply not support those business that allow smoking with my money.

Doesn't that waiteress have the choice to accept the job or not at a business where it is common knowledge that smoking goes on? Is not the waiteress also an adult? I know in the state of Alabama you MUST be 21 to work in a bar, I'll bet you every other state in the Union has the same type of laws.
You are correct to make the choice not or to go any business that alows smoking. That's the key personal responsability, but the anit-smoking nazi's want to make the choice for you, Oh they'll be the first to piss'n'moun if they were forced to make a choice differant then they wanted to make. I think this is a case of the good of the many outway the good of the few.
Knowing what we know about tobacco and the danger of second hand smoke, not to mention the burden it puts on our health care system, I feel we need to protect those who can't protect themselves.
Incidently, I believe you have the right to smoke if you wish, I'm not an advocate for taking that away, but I feel we all need to be responsible and understand just what that smoking does to other people. If you're a smoker and a go to your house, then I accept the fact that I will be subject to second hand smoke, because it's your house. Come to my house and light up...You'll be out on year ear faster than you can say Marlboro.
