Personally, I hold both the club and the band responsible, no matter what the investigation finds, and here's why(please keep in mind, these are just my opinions. By posting them, I'm not dismissing anyone else's feelings, just stating my own):
I'm not going to get into if the band asked for permission or not, we don't know.
I fault the band and their crew because whether you asked for permission or not, you are taking resposibility on yourself when you use pyrotechnics that you will use them as safe as possible. When you walk into the club you'll be preforming at and you see that there are no sprinklers, a low ceiling, and styrofoam on the ceiling, it is your responsibility to say "Well, it doesn't look safe to me, I don't think I'll use the pyros"
I fault the club, because it's your business, and therefore you have a responsibility to make sure that your patrons will be safe. You do this by a) putting in sprinklers, I don't care if you were "grandfathered" in or not, it's just common sense! and b) keeping an eye on what the act preforming in your club is setting up. If you're not sure about something, ask. If they didn't know those things were pyros, they should have asked.
As far as the other club owners, it could be true, but then refer to my last paragraph for my feelings about them. It's also possible that they're saying this to cover their own butts in case the investigation sends officials to their clubs where they don't have those permits either, so that they can say "We didn't give them permission". I don't know, I'm just saying it's a possibility.
Either way, it's sad that so many died because of lack of saftey and forethought on so many others. Just awful
