I have to agree with Rhenquist. Californians decided what they wanted to do, so let them do it. Each State is supposed to be self governing, with limited federal interference. At least that was the theory behind the constitution.
Why should a society tolerate the depredations of repeat offenders? Im pretty sure the guy stealing the golf clubs wasn't doing it because he was cold or hungry or looking for shelter.
