Theoretically, yes. But the Director of the FBI is a (Presidentially) appointed position. And anything as huge as the search of a Congressman's offices would probably go pretty damn high on the totem pole. So there's the appearance of impropriety, which in politics is pretty much the same thing as actual impropriety.
