There is a lot to consider.

If the woman was beastly ugly = rape
If the woman was attractive and the man was single or not dating anyone = unexpected surprise
If the man had a wife or girlfriend who'd find out about this incident = It had darn well better be rape for his sake!!
If the man was gay = rape
If the girl bit him during the process = rape
If the woman looked like his mother = rape
If the man knew it was going on, and waited until the "end" to "wake-up", and shout rape... = The defence is lying for some reason.

On a humorous side-note... I pretended to be asleep once... [img]smile.gif[/img]
