The issue, of course, is not the danger of smoke, second-hand or otherwise; it is a value comparison. Does one -- or, appealing to that popular myth "the will of the people", does the average person -- value health more than freedom? Does the health risk to random people justify restricting the liberty of other random people?
I'd say it does; but that's just me [img]tongue.gif[/img]
