The Ninth Circuit decided the case based on a relevant statute. As one of its basic rules, the courts will not decide something on a constitutional basis unless NOTHING ELSE RESOLVES THE MATTER. The constitution comes last. This case tells us NOTING about how the courts would rule on the constitutional issue. The "legal scholar" who stated "the precedent has been set" is simply WRONG.
