Well... you could steal a lot of stuff and look menacing?
You can't AFAIK actually be a smuggler with contacts and drop-off points and such. However you can be bad - you can become a vampire and join one of the vampire groups. You can join the morag tong and be a hitman. But you can't like, join a bandit group in a bandit cave because they just attack you on sight.
