Thanks to all (esp daan) for help on this, I have to say I thought it was a hard fight.
In the end Minsc (berserked) and protected from magic worked best for me (equipped with Daystar and Flame Tongue) - and none of my party were imprisoned.
"This demi-lich is dead! It is an ex-demi-lich!"
"No its not . . . it's just sleeping."
