You don't have to "attack" them; if you accidentally hit one with a missile miss (or a spell backfires and they happen to catch some of it) and then one is killed--even by an enemy--your faction rating drops.
Because they're always getting in the way, i've killed many on purpose, with Death Clouds etc. and in places where others couldn't see the action, and they never turned, even when it amounted to many dozens.
