The ECL classes just need more experience to advance, it isn't 2 for 1 or 3 for 1 or anything like that. Otherwise, they wouldn't be worth having!
Your L9 Tiefling has enough experience for L10, but because he has that level penalty, he's actually only level 9. When he has enough experience for L11, he'll become L10. And so on.
