1. I think it would be because the CD has scratches... but if you say there are no problems then I wouldnt worry about it.

2. Check your patch.txt file in the game folder... it should contain a section mentioning fixes to HoW and Trials Of the Luremaster:

VERSION 1.42 - HEART OF WINTER Patch / TRIALS OF THE LUREMASTER
--------------------------------------------------------------------------

Edit: I mean if the section is there in the patch.txt file then ToTl shouldve installed properly. I dontknow if there is a way to check in the game itself
