There is no way Yoshimo can be summoned by the Statues of Fate, but I strongly believe (I've never actually done it, but I'm rather sure it can be done) that you CAN have him in your party in ToB, but only by taking him through SoA. There are at least 2 loopholes that enable you to keep Yoshimo after Spellhold. I really should test this, and find out just what he says to Irenicus before the final battle....probably nothing, of course, but you never know.
