Not truly, but the most the xp charts will let you reach is 40th level (by the way, the cap is 8 mil, not 9). Depends on class, too. Fighters can reach level 40, but rangers can only reach level 34. Depends on the xp progression for that class.
Here are the maximums (straight from the manual):
Fighter, Barbarian, Cleric, Monk, Thief, Bard: 40th level
Ranger, Paladin: 34th level
Druid, Wizard, Sorcerer: 31st level
