The "lost familiar" bug was supposed to have been addressed with ToB, but maybe you have a glitch and walked off a map with your familiar not in your pack and he got left behind (poor thing!). Try going back to the place/s where you think you left him.
Also, I'd suggest you download the final ToB patch at
www.bioware.com, this one is no longer a beta.
