I see the issue as along the same lines as shouting a false alarm fire in a theater so far as that the likely result of making the speech is the infliction harm. Rather than panic, the harm inflicted is emotional and psycological.

Not to mention there are plenty of public venues to hold a demostration. It's not like the Phelps family is being pidgeon-hold into some sort of out of the way caged-in zone. We would never allow that either.
