Ok, so he was drunk, get his license taken off him and give him a fine. He didn't kill his friend. He was the driver. His friend must have been totally out of it to be sticking his head out the window, which was nothing to do with the driver. Passengers have to take responsibility for themselves.

How can the passenger take responsibility when the driver swerves towards a roadside object? As Timber pointed out, it's quite possible the passenger was barfing at the time. In that case, hanging your head out the window would be the logical thing to do.
Telephone cables are NOT placed close enough to the road to present a physical hazard, even if some idiot does stick his head out the window. The bottom line is that the driver is 100% responsible for the death of his friend because he swerved the car closer to the edge of the road while his friend was hanging out the window. Chances are, the friend never saw the cable coming.
