No. Neither is illegal. Both, however are a violation of the EULA, a contract between you and Blizzard. It's a civil law issue, not a criminal law issue.

Hmm.. So i could get someone like you to run me through instance, but i get everything, make the gold and sell through Ebay for 100g = $50. Very fun job.

Um... not such a fun job. 100g = more like $10 or less. A pittance for the effort unless you live somewhere where one dollar = much cash.
