You should run into him on your way back to Athkatla after you leave the Underdark. Don't worry, there's no way you can miss him. He's got his bunch with him too.

You can kill him but I heard you can't loot his corpse
because some mages will pick his stuff up after you killed
him.

Correct, you can loot his equipment, but there is an unavoidable spot where Drizzt's personal items will be confiscated.

I read in a post somewhere that it's in Trademeet in one of the circus looking tents. There is a merchant there who you can buy it off. Its somewhere near the Dao Djinn tents in the south of the map.
