I have several music cds which I own in original but some of the tracks won't play now because of extensive use of the cd's, and of course these tracks are the best ones on the cds because I listened to those the most.

My question is wether anyone here can give me any idea of what I can do to solve my problem. Would it be considered legal to download the files. I mean I did buy the cds, or can I complain to the publisher about the weak quality of the cds?

Thanks for your help.

Well, you could have the disc resurfaced, but personaly if the damage is bad enough that cleaning the disc and the drive didn't let me read it, I would just fire up kazaa and burn me a duplicate CD.

IMHO, that should be legal as long as you only get tracks which you already own. No idea if it actualy is or not, even by UK or US law, nevermind french.

AFAIK it is only legal in Belgium, as otherwise you are "stealing" the merchandise. I know that is is not the case with ROMs as you can download them if you have the original.

But don't take my word for it.

I think it is legal since with all software and music you are actually purchasing the license to use it not the piece of plastic it's stored on. So you already have the license, you are entitled to have it in MP3 format as well - what's the difference between ripping it to the HD yourself and downloading it?

But i guess if you relate it to real life (as in not digital) if you buy a product and it breaks it does not give you the right to "steal" another copy. Then again don't listen to me as i would have used kazaa in the first place.

Thanks everyone for your replies.
Just another question: If I have a friend who has the music too ,is it legal if he sends it to me?

I'm not sure if this subject really resides within this boards TOS, but I might be wrong.
