Hmmm. Personally, I don't drive after even one drink... but legally you are allowed a couple of drinks and still be able to drive no? Granted... this store won't help lower any statistics... but as people are allowed to do it any way... is this really illegal? Apart from the no selling cups of ice law.

In the case of the liquor store, it implies breaking an established law in that State against drinking while driving.
