This is a blatant play for sympathy. I have a workman's compensation injury and my arms are in constant pain. The company I worked for admitted that I was injured on the job, but because I didn't report it in 30 days, they won't pay.
So I can't afford a doctor, haven't worked since January - but slowly am healing (or at least not hurting so badly). I went to an informal hearing last Spring. It went well for me. Then the formal hearing. I lost that one. So I had an appeal to file. I got the results in the mail today. I lost that, too. I have more options and I will persue this, but man - this is dragging on for a long time. I have to go back to work (need the money) even though I am still hurt. Have been calling lawyers looking for someone to take my case. This is not only exhausting, but I get a little bit more angry at my former employer because of this waste of time and my lack of health. :( Sigh. That is all... just tired and achy. |
waaaaaaaaaaaaaaaaaaaahhh!!!
dare i ask what you did to your arms? :( |
Do your lawyer searching before you call. You can search for counsel that is in your area and does what you need at this site:
www.martindale.com Only a worker's comp or labor lawyer will take your case, I would say. I can't say more, other than do not delay as the passage of time will likely make your case worse and may bar you from certain avenues of recovery. I'm out of state where you're concerned, or I'd offer to help you look about. Sorry, but the only lawyers I know in TX work for NASA. |
Thank you Timber... been doing phone calls already... will check out the site as well.
Oddly enough, you would think there would be more Workman's Comp lawyers in Dallas then there are. Mainly Personal Injury (the pirana of the profession :( ). I would appreciate any help at all. And if I go into space... I will definitely call!! LOL Thank you for the sympathy, LS. Basically it is your standard repetitive stress injury as far as I know. Haven't really had decent diagnostic to find out what the problem is. But at least typing is not too bad if I don't do it very long! |
Charean-
I'm upset that you would make such a statement about blood-sucking leaches and piranhas like my son-in-law. Seriously I'll check with him and see if I can get the names of any sharks, I mean lawyers, that take workmans comp cases. If I can find out anything I will pm you on Saturday. |
Thank you so much!! I really appreciate any help at all. (grovel grovel) :D
|
typing? shows how long sincee we last spoke LOL!! I thoguht you were doing trucking, lass!
|
Sorry to hear that Charean.
Maybe this is like applying for disablity, they deny you several times before they finally admit you're right, and then pay you back time? You definately need a good lawyer! Good Luck [ 11-01-2002, 04:56 PM: Message edited by: Ronn_Bman ] |

*makes note to self 'don't take up trucking'!* Hope it all works out for you. Pet the bunnies, I'm sure they're good for any type of illness or at least a smile! |
Magik - LOL!!
Cloudy - Thank you. The stick shift was a bit high on the doghouse (one of those technical trucking terms for a hump on the floor) and 6th gear was actually behind me. Pulling on the steering wheel to compensate got both arms strained. I am much better now than I was, so things aren't horrible. The bunnies are an ENDLESS source of amusement for me. I have one that thinks he is a cat and climbs shelves (crazy rabbit) and sits in the window. The other one is like the king of naps. Maybe they were both cats in a previous life. Got bunny? |
LOL@ thought of rabbit in a window! :D
|
Well, they certainly don't lie there in the sun... they are too jittery.
Fiver will sit there, look around.... and continue looking around ready to jump away any time... silly rabbit. |
Insurance companies suck, I should know I work for one.

Took my workcomp over 2 years, and was a month short of trial b4 they caved in and paid because they knew we were going to win...but my case was going to establish legal precedent for MT, because there had never been w.c. case for voice injury. Repetitive stress injury is an established and mature body of case law in every state of the union...you only need keep meticulous records, and you DO have the right to start the legal process yourself, i.e. making sure that you meet the filing deadline for any cause (generally two yrs for wc from date of original injury.) I don't know about the 30 day thing, It was not until 3 months after I lost the ability to speak above a whisper that I even started a workcomp case, and that was originally just to pay for the doctor bills, which were mounting with every visit to the next specialist who told me they had never seen anything like it....a phrase you never want to hear from your doctor, lawyer, or mechanic! Sound like you are on the right track, you must exhaust ALL administrative/agency proceedings b4 a civil process can start... make sure you keep records, and do your original filing yourself... |

Thanks JJ - I do keep good records... have all those papers in a file now - and it is 3 inches thick already. So onward and upward... the search for a lawyer will continue on Monday.
And LS, thank you - you are sweet. I really am better than I was, but not 100%. Who knew that your body falls apart in your 30's?? My mom never told me that!! |

I don't have any problems, but I've often wondered what would happen to me if I lost my voice. I'm a 911 telecommunicator(fancy word for dispatcher/call taker), and a part-time radio announcer. I used to do the radio deal full time, so the only real work I've ever done has been talking. ;) [ 11-02-2002, 08:03 PM: Message edited by: Ronn_Bman ] |

You had to force your voice to be heard over the general noise, and I worked a 4-10 schedule that was a 3-2-1-1 M-W, S. It took about a year and a half before the cumulative effects manifested. Conversational speaking does not bother me, and that job was timed to the 1/100th of a second as far as your time on the phone, which had to be 80% of your total clocked in amount or your bonus ...shrank. Since I happen to be dating a 911 dispatcher right now (as long as her husband doesn't find out! ) I am familiar with the type of schedule you have...should not cause you any probs, but you never know. There is, at this time, an actual impairment rating that has been developed by doctors of the rehabilitive school of trial medicine - came out of a case back east, just 3 weeks b4 my trial was to start. boy, was their scumbag laywer scrambling then!! I think I enjoyed his apology as much as his insurance company's check, lolol. hope that answers your q, if not, let me know. |
