I doubt that it is true, some site probably just put it up to get more hits and the link to download it is probably to some porn site.

I read on TeamBG's web site that ToB went gold on the 14th (4 Days Ago!)

Don't get too excited though. This doesn't mean that it's available in stores, it just means that they are in the process of mass producing, shipping, and distributing them. I'd give it 3-10 more days before going balisitc. (Although personally, I'll be calling the stores every day, sometimes twice).
