The second celebrity cited in the initial lawsuit paperwork is Depeche Mode founder Martin Lee Gore. Estavillo named him in the lawsuit as a sort of 'alienation expert' to testify on the matter, because he's been known to be "sad, lonely and alienated, as can be seen in the songs he writes."

"Sad, lonely, & alienated?" Sounds like Estavillo is his own best witness...

There's no mention of an attorney representing him. They were probably smart enough not to risk being sanctioned for filing a frivolous suit.

What if the WoW gaming community filed lawsuit against him for bringing false allegations against the game, and the lawsuit file for termination of this guy's rights to own a video game, since he wants to self-proclaim his illnesses on these very games. Maybe we can get a psychiatrist to prescribe the ban during testimonial.

Ahhhhh the depravity of the legal system in the US - makes me both proud and glad to be European - No real offense intended.

Evidently this guy has previously made some epic lawsuits vs Sony, Microsoft, and Nintendo...

excerpt
After being banned from Sony's PlayStation Network during a game of Resistance: Fall of Man, a San Jose, California gamer sued the electronics giant, alleging a violation of his First Amendment rights. That case was dismissed in September, but the plaintiff was undeterred. In addition to filing in an appeal in that case, earlier this month he filed a new suit against Microsoft and Nintendo. In that case, he alleged that a broken Xbox 360 caused him undue stress, and that a Wii system update blocking access to the Homebrew Channel third-party program interfered with his inalienable right to pursue happiness.

I can't really speak to the panic disorders, agoraphobia and depression, but I CAN unequivocally state that OCD and Chron's Disease can not possibly be caused by playing a video game - even if he plays it obsessively.

OCD is a psychiatric disorder that involves far more than just being obsessed over playing a game. OCD sufferers have rituals they MUST go through several times a day (such as turning light switches on and off a specific number of times before leaving the room or washing their hands compulsively).

As for Chron's Disease, I could post volumes on that after having lived with the disease 25+ years and suffered the worst it has to offer. Even doctor's are not entirely sure of it's cause, although most research suggests it is genetic in origin.

Being obsessed with WOW might aggravate OCD and Chron's, but it has absolutely nothing to do with their causes.

Well it IS nice to know any citizen can file a lawsuit for a supposed wrong done to them and be relatively assured of their day in court. Of course, the flipside to that is that you also get extremely frivolous and ridiculous lawsuits (such as this) filed because of that right as well.

Is it bad that I actually want him to succeed in his lawsuits? :D

Re: Gamer sues WOW-

This is just like the guy that suied McDonalds for the coffee being hot. People are greedy and bored. Of course, people have always been greedy to some degree, its human nature, but its getting to the point where we say.."Where will it stop?"

Next thing you know we'll be suing the pants off of each other for small injustices that could, in the old days, be settled in a dual. Duals were fought with honor and dignity, now days people do drive by's, which is cowardly to a degree that sickens me. But, i am getting off track.

Challenge them to a duel like in the days of old. Yet, alas, most people either dont have the stomach, or the honor, or whatever the case may be....which is why we have so many frivilous lawsuits in our country.

People suing because they're lazy?!! Because they cant put down the controller and walk outside for a while? Now of course sometimes i get so into a game i sit for half a day or so, but i do exercise as much as possible (recent back injury notwithstanding) and exercise is the key to a lot of things.

I have the odd feeling that im rambling.......so i guess i'll leave it at that.

I used to work for Blizzard - though in Europe and I can say without any doubt in my mind that the biggest wow junkies of the world are the people behind the game. In this I mean the Game Masters and the developers - they live with it 8 hours at work and go home to raid with their friends - most of those being colleagues.

I can see your point - but the thing I don't like is that it opens up for stuff like this - alas - there is a silver lining to every dark cloud and every coin has a dark side too...So I think I do understand your point after all.

I thought about freedom of speech and that brought up the ridicolous muhammad crisis we had in Denmark - so I guess there is a flip side to freedom of speech too...
