The nasty habit that Nishruus have of destroying magical items that don't use charges is one of the bugs that Interplay's new BG2 patch is supposed to fix. Hop over to their website (www.interplay.com) and click on the BG2 link. It should be right there for you to download.

I never had any problems with Nishruus the first time around, since every time I went up an enemy that summoned creatures, I'd have one of my spellcaster's hit'm with a Death Spell, which automatically kills them even though they're supposed to be immune to magic.
